Transfer terms

These are the terms you accept when you pay the transfer fee, online or at the counter. How the service works.

What these terms cover

National Safety Center LLC holds a Federal Firearms License and receives firearms shipped to us by other licensed dealers for transfer to the person who bought them. These terms govern our receiving, handling, storage, transfer, return and, where necessary, lawful disposition of a firearm sent to us for your transfer.

These terms apply to each firearm sent to National Safety Center in connection with the transfer request for which you accept them. You should accept these terms before directing a seller or another dealer to ship a firearm to us. If you do not agree with them, arrange for the firearm to be shipped to another dealer before it leaves the seller.

By electronically accepting these terms as part of your transfer request or payment process, you agree that they form part of your transaction with National Safety Center and that your electronic acceptance is intended as your signature and agreement to these terms, including the security interest described below.

Receiving or holding a firearm does not by itself make National Safety Center its owner. Ownership and other rights between you, the seller and any other person are determined by the underlying transaction and applicable law. To the extent you have rights in a firearm sent to us for your transfer, those rights are subject to these terms and the security interest you grant to us below.

The transfer fee

The transfer fee is $35 for each firearm we receive for you. It is due before the firearm is released, and you may pay it online through the link we send you or at the counter.

The fee covers receiving the firearm, entering it in our federal records, administering the transfer, completing ATF Form 4473 with you, submitting the applicable Florida background check, and completing the lawful hand-over. It does not cover storage beyond the pickup window, return shipping, seller charges or other costs described in these terms.

Once a firearm has arrived and has been entered in our records, the transfer fee is earned and is not refunded, including where you change your mind, do not collect the firearm, are denied or otherwise unable to complete the transfer, or the firearm must be returned or otherwise lawfully disposed of.

If the seller never ships the firearm, nothing is charged, and any transfer fee already paid for that firearm is refunded.

Paperwork, eligibility and the waiting period

Federal law requires ATF Form 4473 to be completed by the actual transferee. Florida requires the applicable background check through the Florida Department of Law Enforcement before we may release a firearm. We complete the required transfer process with you at our premises.

Bring current government-issued photo identification showing your present residence address and any additional documentation required by law. If the address on your identification is not current, additional government documentation may be required.

Florida generally imposes a waiting period of 3 days between the purchase and delivery of a firearm unless an exemption applies. A lawful local waiting period may also apply. National Safety Center will not release a firearm until the applicable waiting period has expired and all other legal requirements have been satisfied.

Depending on when the firearm was purchased, when you come to us, and whether an exemption applies, more than one visit may be required.

You must be legally eligible to receive and possess the firearm. National Safety Center may refuse or discontinue a transfer that we reasonably believe would be unlawful, would circumvent a legal requirement, would constitute a straw transaction, or would otherwise place National Safety Center in violation of its legal or regulatory obligations.

We will not release a firearm to anyone merely because that person claims an interest in it. Any transfer must be one that National Safety Center can lawfully make.

If the check is delayed, denied or not approved

If your background check is delayed or otherwise remains pending, the firearm remains in our custody until the transaction may lawfully proceed or another lawful disposition is arranged. The pickup and storage provisions below continue to apply while the firearm remains with us.

If your background check is denied or not approved, we will not release the firearm to you. You are responsible for pursuing any appeal, correction or other available process with the appropriate government agency.

You have 90 days after we notify you of the denial or nonapproval to resolve the matter, provide us reasonable evidence that you are actively pursuing a timely appeal or correction, or arrange with us for another lawful disposition of the firearm.

A government agency may impose an appeal deadline that is shorter than our period. You are responsible for complying with the government deadline. Our terms do not extend any deadline established by law or by a government agency.

If you provide reasonable evidence that a timely appeal or correction remains actively pending, we may continue holding the firearm while that process is pending. Storage charges continue to apply under these terms unless we agree otherwise in writing.

If you do not resolve the matter, actively pursue a timely appeal or correction, or make another written arrangement with us within 90 days, the firearm will be treated as an uncollected firearm in default under these terms and may be returned or disposed of as provided below.

A denial or nonapproval does not give you an automatic right to direct us to transfer the firearm to a spouse, family member, friend or other person. We may refuse any proposed transfer that we reasonably believe could constitute a straw transaction, an attempt to circumvent a background check or another unlawful transfer.

If you change your mind or request a return

If you decide not to complete the transfer, contact us promptly.

Where legally permitted and accepted by the originating dealer, we may return the firearm to that dealer. Return shipping, insurance, packaging, handling, the seller's charges and any restocking fee are your responsibility unless the seller agrees otherwise.

National Safety Center is not responsible for the seller's refund policy, restocking charges, refusal to accept a return or any dispute between you and the seller.

While a return or other disposition is being arranged, the firearm remains subject to the pickup, storage and payment provisions of these terms.

Pickup window and storage

You must come in to begin or complete the transfer process within 7 days after our arrival notice and collect the firearm as soon as it may lawfully be released.

An applicable waiting period will not cause you to lose the benefit of the pickup window. If you timely complete everything required of you but the firearm must remain with us solely because a legally required waiting period has not expired, that additional required time is not treated as your failure to collect the firearm.

Our arrival notice may be sent to the email address or telephone number you provided to us. It is your responsibility to keep your contact information current with us and with the seller.

After the pickup window, storage of $30 is charged for each month, or part of a month, that the firearm remains in our custody. Storage is due before the firearm is released or returned, together with the transfer fee and any other amounts due.

Storage continues until the firearm is lawfully transferred, returned, sold or otherwise disposed of.

If 90 days pass after our arrival notice without the transfer being completed and without a written arrangement with us, the firearm is considered uncollected and you are in default under these terms.

The passage of the uncollected-firearm period does not automatically transfer ownership of the firearm to National Safety Center. Instead, National Safety Center may exercise the return, security-interest and disposition rights described below.

Security interest in an uncollected firearm

By accepting these terms, you grant National Safety Center LLC a security interest in all of your right, title and interest in the specific firearm or firearms sent to National Safety Center in connection with the transfer request to which these terms apply, together with any property belonging to you that was delivered with them.

The firearm or firearms covered by this security interest are objectively identified by the transfer transaction through which you accepted these terms and by the firearm or firearms actually received by National Safety Center for that transaction.

This security interest secures all amounts you owe National Safety Center in connection with the firearm, including the transfer fee, storage charges, return shipping and handling, and reasonable costs of preserving, holding, valuing, preparing, advertising, selling or otherwise lawfully disposing of the firearm. It also secures reasonable enforcement and legal expenses to the extent permitted by applicable law.

These terms are intended to constitute a signed security agreement under applicable Florida secured-transactions law. Your electronic acceptance of these terms is intended to constitute your signature to that security agreement.

The security interest applies only to rights in the firearm that you actually possess or have the power to grant. Nothing in these terms gives National Safety Center greater rights than applicable law permits or defeats a superior ownership or security interest held by another person.

National Safety Center may retain possession of the firearm while amounts secured by it remain unpaid, to the extent permitted by law.

Default and disposition of an uncollected firearm

You are in default under these terms if an amount due to National Safety Center remains unpaid, if you fail to perform an obligation required by these terms, or if 90 days pass after the applicable notice without the firearm being collected, the transfer issue being actively resolved, or another written arrangement being made with us.

After default, National Safety Center may continue to store the firearm and accrue applicable charges, return the firearm to the originating dealer or another person legally entitled to receive it, or exercise the remedies available to a secured party under applicable Florida law.

Those remedies may include selling or otherwise disposing of your interest in the firearm and applying the proceeds to the amounts secured by it.

Before selling or disposing of a firearm under our security interest, we will provide the notice required by applicable law to you and to any other person entitled to notice.

Any sale or other disposition will be conducted in a commercially reasonable manner and in compliance with applicable firearms laws. Depending on the circumstances, the firearm may be sold through our ordinary retail operations, to another licensed dealer, through an established firearms marketplace or auction, or by another commercially reasonable method customary for firearms of that type.

National Safety Center may consider the firearm's condition, dealer and retail market information, comparable sales, wholesale values, recognized pricing information and other commercially reasonable information when determining an appropriate method and price for disposition.

No sale under this section permits National Safety Center to disregard federal or Florida firearms laws. Any subsequent purchaser or transferee must complete every background check, form, waiting period and other requirement applicable to that transaction.

Sale proceeds, surplus and redemption

Money received from a disposition of an uncollected firearm will be applied in the order required by applicable law.

This may include reasonable expenses of holding, preparing and disposing of the firearm, followed by the transfer fee, storage charges and other obligations secured by the firearm.

If the lawful charges and expenses exceed the amount recovered, you remain responsible for any deficiency to the extent permitted by law.

If money remains after all amounts that may lawfully be paid from the proceeds have been satisfied, any surplus belonging to you will be accounted for and made available to you as required by law.

Until the firearm has been sold or National Safety Center has entered into a binding agreement for its disposition, you may exercise any right of redemption provided by applicable law by satisfying the secured obligations and permitted expenses.

Redeeming your financial interest in a firearm does not require National Safety Center to physically transfer the firearm to you unless you are legally eligible to receive it and all applicable transfer requirements have been satisfied.

Nothing in these terms waives any notice, redemption, accounting, surplus or other right that applicable law does not permit you to waive in advance.

Seller or third-party claims

National Safety Center is the receiving dealer and is not a party to the purchase agreement between you and the seller unless we expressly state otherwise.

If the seller, a secured creditor, law enforcement agency or another person establishes a superior legal right to the firearm, National Safety Center may hold, return or otherwise deal with the firearm as required or permitted by law.

If a genuine ownership dispute arises, National Safety Center may continue holding the firearm and accruing applicable storage charges while the parties resolve the dispute, or may take another lawful action reasonably necessary to protect National Safety Center and the firearm.

National Safety Center is not required to decide a private ownership dispute between you and another claimant.

Shipping, condition and seller disputes

National Safety Center is not the seller of a firearm transferred to us from another dealer and does not make the seller's representations or warranties concerning the firearm.

A dispute concerning the firearm's description, condition, value, warranty, accessories, seller performance, refund or other terms of your purchase is between you and the seller.

We will reasonably document visible shipping damage or an obvious discrepancy that we identify when receiving the package. We do not test-fire, disassemble or perform a gunsmith inspection of a transferred firearm unless separately agreed.

We enter the firearm into our federal records using the identifying information required by law. Our receipt of the firearm does not constitute an inspection or acceptance of its condition on your behalf.

Insurance, risk and our liability

You are responsible for arranging any insurance you want for the firearm from the time it is shipped until you lawfully take possession of it. National Safety Center does not undertake to obtain insurance for you.

National Safety Center is not responsible for loss, theft, damage, delay or shortage occurring before the firearm is actually received by us or after it has been lawfully delivered by us to a carrier or other authorized recipient.

While the firearm is in our custody, National Safety Center will exercise the level of care required by applicable law but is not an insurer of the firearm.

To the fullest extent permitted by Florida law, National Safety Center is not liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from an FFL transfer, including loss of use, lost value caused by delay, lost profits, travel expenses or losses resulting from a seller's actions or refund policy.

Nothing in these terms excludes or limits liability where Florida law does not permit that liability to be excluded or limited.

What we will not receive

  • Items regulated under the National Firearms Act, unless arranged with us in writing before shipment.
  • A firearm that is unlawful for us to receive, possess or transfer.
  • A firearm shipped by anyone other than a federally licensed dealer, unless arranged with us in writing before shipment.
  • A shipment that cannot reasonably be matched to a customer or transfer request.
  • A shipment that National Safety Center determines it cannot lawfully or reasonably process.

An unauthorized or unidentified shipment may be refused or returned where legally permitted, and reasonable costs associated with the shipment or return are the responsibility of the person who caused it to be sent to us.

Your information and notices

You are responsible for providing accurate contact information and keeping it current until the firearm has been collected, returned or otherwise disposed of.

Unless applicable law requires a different form of notice, we may communicate with you using the last email address, telephone number or mailing address you provided to us.

A failure to receive a communication because you supplied incorrect information or failed to update your information does not by itself extend a deadline when National Safety Center reasonably sent the communication using the information on file.

We keep the acquisition, disposition, ATF Form 4473 and other records that federal or state law requires us to keep. We may also retain transaction, payment, contact, acceptance and communication records reasonably necessary to administer the transfer and enforce these terms.

We may disclose information when required by law or reasonably necessary to conduct the background check, administer the transaction, process payment, comply with our regulatory obligations or respond to lawful governmental requests. We do not sell your personal information.

Electronic acceptance

When you electronically accept these terms as part of requesting, booking or paying for an FFL transfer, you intend that action to authenticate and adopt these terms as your agreement with National Safety Center.

Your acceptance applies to the specific transfer transaction for which it was given and to each firearm received by National Safety Center in connection with that transaction.

National Safety Center may retain an electronic record of your acceptance, including the applicable terms version, effective date, transfer or transaction identifier and information establishing when and how the terms were accepted.

You agree that an electronic copy of these terms and our electronic record of your acceptance may be used to establish the terms you accepted.

Governing law, enforcement and severability

These terms and the FFL transfer service are governed by Florida law.

To the extent permitted by applicable law, any dispute arising from these terms or the transfer service must be brought in a court of competent jurisdiction serving the county in which National Safety Center's licensed premises are located.

If any provision of these terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

National Safety Center's decision not to enforce a provision on one occasion does not waive the right to enforce it later.

A written arrangement we make with you concerning a particular transfer may modify the applicable timing or handling of that transfer, but no oral statement modifies these terms.

Changes to these terms

These terms are version 3, effective September 6, 2026. The version you accepted for a transfer is the version that applies to that transfer, and we keep a record of which version was accepted.

We may change these terms for future transfers. A later version does not replace the version governing an existing transfer unless you affirmatively agree to the change.
